The volume gives the point of view of some Italian and foreign scholars and experts on the use of trusts for the management, enhancement and transmission of artistic collections, both public and private. In the first part the authors analyze the functioning of the Charities in the legal systems that have historically made use of this instrument but also in the legal systems of emerging countries such as the People's Republic of China; the reflections on public trusts also present significant arguments for the evolution of the protection of cultural heritage in continental legal systems such as the French one. The second part deals with the transmission and inheritance of the artistic estates of private collectors and of the artists themselves from the point of view of the civil law systems, examining the operation of foundations, artist's archives and internal trusts.
Il volume offre il punto di vista di alcuni studiosi e professionisti italiani e stranieri sull'utilizzo del trust per la gestione, valorizzazione e trasmissione di patrimoni artistici sia pubblici che privati. Nella prima parte viene analizzato il funzionamento delle Charities negli ordinamenti che storicamente si sono avvalsi di questo istituto ma anche in ordinamenti di paesi emergenti come la Repubblica Popolare Cinese; le riflessioni sui public trusts offrono poi significativi argomenti per l'evoluzione della tutela dei beni culturali in sistemi giuridici continentali quale quello francese. La seconda parte affronta il tema della trasmissione di patrimoni artistici di collezionisti privati e degli artisti stessi dal punto di vista degli ordinamenti di civil law, vagliando l'operatività di istituti quali le fondazioni, gli archivi d'artista ed i trusts interni.
