The essay fucuses on the science of criminal legislation in Italy, identifying its macro-characteristics: a networked structure, its function as a mechanism of normative production, its narrative dimension, and finally, its being a science in dialogue with other disciplines. The science of criminal legislation is also a science constantly called upon to question itself. The introduction of restorative justice has highlighted certain historical challenges within the science of criminal legislation, which is now faced with a subject that is fluid by nature, perpetually evolving, flexible in the methods it proposes, imbued with value-based and teleological elements that are difficult to define univocally, ontologically extra-penal, distant from the technicalities of the sanctioning system's mechanisms, extra-procedural yet called to resonate with the structures of the legal process.
Il saggio fa il punto sulla scienza della legislazione penale in Italia, individuandone le macro-caratteristiche: struttura reticolare, il suo essere un congegno di produzione normativa, avente una dimensione narrativa e, infine, l'essere una scienza in dialogo con altre discipline. La scienza della legislazione penale è anche una scienza chiamata a mettere costantemente in discussione se stessa. L’introduzione della restorative justice ha reso evidenti talune difficoltà storiche della scienza della legislazione penale chiamata oggi a confrontarsi con una materia che, per sua stessa natura, è fluida, in quanto perennemente in divenire, flessibile nei metodi che propone, intrisa di elementi valoriali e teleologici difficili da indicare univocamente, ontologicamente extra-penale, lontana dal tecnicismo dei meccanismi applicativi del sistema sanzionatorio, extra-processuale ma chiamata ad entrare in rapporto di risonanza con le strutture del processo.
