While it was working-out a new code of criminal procedure, it took place the Fifth National Legal Congress in Palermo (1903) and one of the debating points was the legal protection of poor people in criminal trials. In their lectures, Francesco Carfora, Pasquale Tuozzi e Gaetano Leto highlight mainly two problems that entail negative consequences for the proper justice administration: the free professional performance and the secret judicial inquiry. About the first problem, Leto claims that the State must be compelled to reward pleaders, but Carfora and Tuozzi, aware of the financial difficulties of the Italian Kingdom, suggest a reorganization of the system by the Bar association. About the second problem, the three lawyers hope that the legislator reforms the judicial inquiry and allows the pleaders, promptly appointed, to take part in some preliminary investigations.
