The Harmonization of the Data Protection Law: Critical Remarks on the New European General Regulation

The paper aims to analyse the data protection framework applicable in the European Union after the adoption of the General Data Protection Regulation. The analysis is carried out by the point of view of the controller. The implementation of the general principles contained in the regulation needs to be interpreted by the controller that will have to deal with the legal uncertainty arising from the discretionality of the adopted norms.

Il contributo si propone di analizzare il quadro di protezione dei dati personali applicabili nell'Unione europea dopo l'adozione del regolamento generale (GDPR) sulla protezione dei dati generali. L'analisi viene effettuata dal punto di vista del data processor responsabile. L'applicazione dei principi generali contenuti nel regolamento deve essere interpretato dal data controller che deve superare l'incertezza giuridica derivante dalla discrezionalità delle norme adottate.
