This paper takes into consideration the growing trend of contractualisation of environmental law, trying to highlight positive and negative aspects, also in the light of the phenomena of legal transplants at global level. In view of the variety and complexity of interactions between contract and environment, it has been considered appropriate to focus the attention on some experiences considered significant from a comparative point of view. From the analysis it has emerged that the use of contractual instruments in the environmental field entails, on the one hand, an evolution of environmental law, that becomes more flexible, negotiated, and the result of the consent of the addressees of the rules themselves, and on the other hand, a transformation of contract law, taking into account not only the interests of the contracting parties, but also the general interest in environmental protection, acquiring a new “solidarity” dimension.
Il contributo prende in esame il crescente fenomeno di contrattualizzazione del diritto ambientale, cercando di mettere in evidenza aspetti positivi e negativi, anche alla luce dei fenomeni di circolazione di strumenti e modelli giuridici a livello globale. Considerate la varietà e la complessità delle interazioni tra contratto e ambiente, si è ritenuto opportuno concentrare l’analisi su alcune esperienze ritenute significative sotto il profilo comparatistico, da cui è emerso come il ricorso a strumenti contrattuali in campo ambientale comporta, da una parte, un’evoluzione del diritto ambientale, che diviene maggiormente flessibile, negoziato, frutto del consenso degli stessi destinatari delle norme, e dall’altra parte, una trasformazione anche del diritto dei contratti, che tiene conto non solo dell’interesse dei contraenti, ma anche dell’interesse generale alla tutela dell’ambiente, acquisendo una nuova dimensione “solidaristica”.
