This article discusses recent trends in the reconciliation of the interests of foreign investors to a stable and predictable legal framework in host States and those of host States and of the international legal order in its entirety to pursue polices of environment protection. Such trends include the growing admissibility of environmental counterclaims by host States involved in investment disputes with foreign investors, and treatymaking practices growlingly allowing the pursuit of environmental measures by host States.
