L’obbligo degli Stati Membri di garantire la connettività fluviale alla luce delle più recenti riforme

The article aims to analyze the innovations wants to bring by the Nature Restoration Law in terms of the obligation to remove river barriers in order to achieve the objective of having at least twenty-five thousand kilometers of rivers free-flowing by 2030. The Biodiversity Strategy and the Nature Restoration Law are in continuity, on the one hand, with the more general framework outlined by the Water Framework Directive (WFD, Directive 2000/60/EC), and, on the other, with the projects of dam removals already implemented. The aim is to demonstrate the need for interventions not to be disconnected from the reality of the territories and, to this end, the article places river contracts at the center of the reflections.

L’articolo mira ad analizzare le innovazioni che la Nature Restoration Law vuole apportare sotto il profilo dell’obbligo di rimuovere le barriere fluviali, al fine di raggiungere l’obiettivo che almeno venticinque mila chilometri di fiumi siano entro il 2030 a flusso libero. La Strategia sulla biodiversità e la Nature Restoration Law si pongono in continuità, da un lato, con il quadro più generale delineato dalla Direttiva Quadro sulle Acque (WFD, Direttiva 2000/60/CE), e, dall’altro, con i progetti di rimozione delle dighe già attuati. Si vuol dimostrare la necessità che gli interventi non siano disconnessi dalla realtà dei territori e, a tal fine, l’articolo pone al centro delle riflessioni i contratti di fiume.
