Il lavoro si propone di esaminare, nell’ottica dell’analisi processuale, i principi espressi dalla Corte di cassazione in merito al pedinamento elettronico posto in essere mediante trasmettitori GPS, con particolare riferimento alla sua natura processuale, alla capacità di ledere i diritti fondamentali della persona e alla disciplina conseguentemente applicabile.
Il rapporto tra pedinamento elettronico tramite GPS e diritti fondamentali costituzionalmente tutelati al vaglio della Corte di cassazione. Un castello costruito su fondamenta di sabbia?
